Since 1978, the Office of Special Counsel (OSC) has failed to live up to its mission to protect whistleblowers, and has been dominated by political appointees. Now, the former head of whistleblower enforcement, Scott Bloch, pleaded guilty to serious criminal misconduct. This only serves to highlight how the OSC has been abused by politicians intent on having the foxes guard the chicken coop.

But on tax day this year a great injustice continues: whistleblower Bradley Birkenfeld, who exposed UBS' $20 billion offshore illegal tax fraud scheme, remains incarcerated in federal prison. The person solely responsible for the recovery of billions of U.S. tax dollars is the same person who has served more time than anyone connected to the UBS scandal.

For years we have asserted that effective federal employee whistleblower reform requires court access, and that the politically appointed Merit Systems Protection Board (MSPB) fails to effectively protect federal employee whistleblowers. New data obtained under the Freedom of Information Act proves that the watered-down Senate Whistleblower Protection Enhancement Act (S. 372) will not work. -
For months, we've been telling you about the dangerous provisions included in the Senate version of the Whistleblower Protection Enhancement Act (S. 372). We have now learned that S. 372 is being "hotlined," a process by which legislation can be passed through unanimous consent, without any debate or a roll-call vote. -
Today at approximately 2:00 pm EST, UBS whistleblower Bradley Birkenfeld reported to federal prison to begin a 40-month sentence. This miscarriage of justice will have the perverse effect of silencing whistleblowers who want to report tax fraud. In our entire history tracking whistleblower cases, this is the most abhorrent action ever taken against a whistleblower. Mr. Birkenfeld deserves to be commended for protecting the American people and yet he faces the loss of his liberty.
