Citizens' Handbook Explains SEC Whistleblower Process

Washington, D.C. December 8, 2011. The National Whistleblowers Center (NWC) is proud to announce the release of the second edition of The Whistleblower's Handbook: A Step-by-Step Guide to Doing What's Right and Protecting Yourself. This second edition includes a new 20--page checklist on the procedures for obtaining Dodd-Frank Act rewards from the Securities and Exchange Commission (SEC). The checklist covers the SEC's regulations that went into effect on August 11, 2011 and provides insights on how whistleblowers can use the new regulations to maximize their potential rewards. See pages 276-296.

Penn State Urged to Avoid Tainted FBI Officials

NWC Demands Holder Investigate FBI Failures in Child Sex Crime Cases

Washington, D.C. November 22, 2011. Today, the NWC issued a letter calling for an independent investigation of child sex abuse cases that were mishandled by the Federal Bureau of Investigation (FBI) and FBI Director Robert Mueller.

Additionally, the NWC called upon Penn State to ensure that former FBI agents involved in the misconduct in the handling of child sex crimes within the FBI are explicitly barred from any involvement in the Penn State investigation and that former Director Louis Freeh be questioned as to his knowledge of the FBI's failures.

Grand Jury Report Sheds Light on McQueary's Whistleblower Status

Washington, D.C. November 15, 2011. Today, NWC Executive Director Stephen M. Kohn issued the following statement on the child sex abuse scandal at Penn State:

There has been much debate about whether Coach Mike McQueary is a whistleblower. While the NWC takes no position on the outcome of the investigation, there are two facts that are important to note.

First, McQueary's initial report as a graduate assistant to his supervisor, Joe Paterno, was a protected disclosure under Pennsylvania law. The Pennsylvania whistleblower law protects employees who "report" wrongdoing "verbally" to their "superior" or to an "agent of the employer." McQueary also went beyond just reporting it to his supervisor. He reported what he saw to two high-ranking university officials, including a senior Vice President who had supervisory authority over the campus police.

Whistleblower Issues Statement on Penn State Child Abuse Scandal

Washington, D.C. November 11, 2011. Today, Federal Bureau of Investigation (FBI) whistleblower Jane Turner issued a statement on the Penn State child sex abuse scandal. Ms. Turner, a 25-year veteran Agent, blew the whistle on the FBI's failure to provide protection for child sex crime victims on the North Dakota Indian Reservations. Ms. Turner reported the allegations to the highest level of the FBI, including Director Mueller. Her allegations included the FBI's: failure to act on leads concerning a international long haul truck driver pedophile, cover-up of a rape of a 2-year old child by declaring her injuries to be a result of a car accident, and failure to follow-up on the direct evidence that a television personality was sexually molesting children on the Indian Reservation.

Major Reversal: House Cuts Whistleblower Jury Trials

20-13 Vote Strikes Jury Trials for Federal Employees

 

Washington, D.C. November 3, 2011. During today's mark-up of H.R. 3289, a bill amending the Whistleblower Protection Act, the House Committee on Oversight and Government Reform voted to strip federal employee whistleblowers of a right to jury trial. The committee voted to approve the reform amendments without fixing other significant defects including limits on appeals and authorizing an administrative board to summarily dismiss whistleblower cases.
