NWC Condemns Senate Stagnation on MSPB Nominee Confirmations

The Merit Systems Protection Board has operated without a quorum for five years, leaving thousands of federal employee whistleblower cases in limbo while the Senate delays confirming three presidential nominees to restore the agency’s functioning.

WASHINGTON, D.C. | January 10, 2022 — National Whistleblower Center (NWC) condemns the Senate’s unacceptable delay in confirming President Biden’s three nominees to the Merit Systems Protection Board (MSPB).

This weekend marked a grim anniversary: the MSPB has now been without a quorum for five years, denying federal employees critical workplace protections. As the quasi-judicial agency tasked with oversight of federal employee whistleblower cases, a functioning MSPB must be a top priority for whistleblower advocates.

This past fall, the Senate Committee on Homeland Security acted swiftly: following a September 22 hearing, the nominees were advanced on October 6. The final hurdle is a floor vote by the full Senate, which has yet to be scheduled.

In the five years without a quorum, thousands of cases have been stuck in limbo. This gargantuan backlog continues to grow every day the Senate does not confirm these nominees. NWC is asking supporters to take action today and urge their Senators to confirm the MSPB nominees immediately.
