An Interview with Vivek Kothari
How does your experience as a former federal prosecutor influence how you practice law?
As a former federal prosecutor, I have a unique edge in the whistleblower landscape. It has helped me forge strong relationships with government attorneys, allowing me to understand their needs and priorities when evaluating cases. This insight enables me to present cases in a way that aligns with what’s most important to them, increasing the likelihood of government intervention. By bridging the gap between whistleblowers and federal agencies, I can effectively advocate for my clients and help ensure their claims are taken seriously.
Was there a whistleblower resolution that kicked off this chapter of your career?
It wasn’t a specific case that led me here. After serving as a federal prosecutor, I took time to reflect on what I wanted my practice to look like. Whistleblower cases offered the ability to do meaningful work in partnership with individuals who are doing something incredibly brave and difficult. It spoke to me.
This practice isn’t just about the legal fight; it’s about helping people navigate one of the hardest chapters of their lives and guiding them through uncertainty. Being able to make a tangible impact — not just for my clients, but for the public good — reinvigorated my career. It’s rewarding to know that together, we’re working to hold powerful entities accountable and protect critical resources, like government programs, from fraud. This partnership with whistleblowers has shaped my practice and given it purpose.
Whistleblowers often face significant personal and professional risks. How do you guide clients through these challenges?
Whistleblowing can feel isolating, so I want to make sure my clients know they’re not alone — whether it’s answering questions, discussing strategy, or simply being there as a steady guide. From our very first conversation, I work to build trust by listening to their concerns and helping them understand what to expect at every stage of the process. Beyond the legal side, I connect clients with resources — whether that’s counseling, career guidance, or peer support networks — to help them feel supported through this difficult time.
I also try to help them navigate the personal and professional challenges they may face. Whistleblowers often risk their careers, reputations, and even relationships by coming forward. I ensure they know their rights under laws like the False Claims Act, which provides strong protections against retaliation.
Ultimately, my goal is to empower whistleblowers to stand up for the truth with confidence, knowing they have someone in their corner to guide and protect them.
What are some common misconceptions about whistleblowers and the legal process involved in these cases?
Their motivation. Whistleblowers act on a sense of justice to expose wrongdoing, fraud, or danger to public safety. They take significant personal and professional risks to shed light on illegal or unethical behavior, often enduring retaliation and stigma from their family and coworkers. Despite these challenges, whistleblowers play a critical role in holding organizations accountable and protecting public funds, ensuring that taxpayer money is used appropriately and responsibly. Their courage often serves as the first step in uncovering significant fraud or misconduct that might otherwise go unnoticed.
As for the legal process, whistleblowers are often surprised to learn that the government does not have the resources to investigate every claim. Agencies prioritize cases that are well-documented, involve significant sums of money, or address pressing public interests. Even when a claim is valid, resource limitations may lead to delays, a lack of intervention, or the government declining to pursue the case.
What are some highlights of working with whistleblowers?
The highlights of working with whistleblowers are many, but what stands out to me is the challenge and reward of exposing fraud. Fraud operates in the shadows, hidden by layers of deceit, and unraveling those schemes is both fascinating and complex. I enjoy digging into the details, piecing together the puzzle, and presenting a clear, compelling case that shines a light on wrongdoing.
It’s also incredibly meaningful work. Whistleblowers are often up against powerful entities and face immense personal and professional risks to do the right thing. Partnering with them to expose fraud not only helps protect government resources but also contributes to accountability and fairness. Helping my clients navigate this process and seeing their bravery make a tangible impact is one of the most rewarding parts of my practice.
